Dave’s Killer Bread General Facebook Giveaway Official Rules

NO PURCHASE NECESSARY TO ENTER OR WIN. 

Dave’s Killer Bread Facebook Giveaways (the “Giveaway”) are open to legal U.S. residents residing in any of the 50 United States and the District of Columbia, who are 18 years of age or older and have a unique, personal and valid social security number at the time of entry.  Employees of the Sponsor, its affiliates, parents companies and subsidiaries, and each of their respective divisions, affiliates, contractors, subsidiaries, distributors, sales representatives, retailers,  and advertising and promotion agencies (collectively, the “Giveaway Entities”) and their immediate family members (parents, children, siblings or spouse, regardless of where they live, or persons living in same household, whether related or not) and any others engaged in the development, production, execution or distribution of the Giveaway are not eligible. Giveaway is void in Puerto Rico, U.S. territories and possessions outside of the 50 United States, and where restricted or prohibited by law.

HOW TO ENTER: Visit https://www.facebook.com/DavesKillerBread and complete the following required steps in order to receive one (1) entry into the Giveaway:

1.     Post a comment in response to prompt on the giveaway post

Limit to one (1) entry per person.  24 hours after the Giveaway post goes up on the wall, winners will be chosen via random.org at the sole discretion of the Sponsor. The winner will be selected and notified through Facebook reply. In order for an online entry to be valid, entrant must have a valid Facebook account and must respond to the giveaway prompt on the Facebook page. If the registration process is aborted before it is complete, entrants are not eligible to win.  Any attempt by any entrant to obtain more than the stated number of entries and/or submit entries by using multiple/different email addresses, identities, registrations, logins, and/or any other methods will void that entrant’s participation and that entrant may be disqualified from the Giveaway.  In the event of a dispute regarding the identity of the person submitting an entry, the entry will be deemed submitted by the person in whose name the Facebook account is registered.  Entries will be deemed made by the authorized account holder of the submitted Facebook account at the time of entry. The authorized account holder is the natural person who is assigned to the Facebook account by an Internet access provider, on-line service provider, or other organization that is responsible for assigning Facebook accounts, or the domain associated with the submitted Facebook account. Potential winners may be required to show proof of being the authorized account holder.

PRIZE: The prize is outlined in the giveaway post. No PRIZE substitutions except at the Sponsor’s sole discretion or as otherwise provided herein. The Sponsor reserves the right to substitute a PRIZE of equal or greater value if PRIZE becomes unavailable due to reasons beyond the reasonable control of the Sponsor. PRIZE is not transferable prior to award. The value of the PRIZE may be taxable as income and the winner is solely responsible for any taxes on the PRIZE, including, but not limited to all applicable federal, state and local taxes if applicable.  No more than the number of prizes set forth in these Official Rules will be awarded.

GENERAL RULES OF PARTICIPATION: By participating in the Giveaway, all entrants and the winner release each and all of the Giveaway Entities from any and all liability, damages or causes of action (however named or described) with respect to or arising out of participation in the Giveaway, and/or the receipt or use/misuse of the PRIZE awarded, including, without limitation, liability for personal injury, death or property damage.  By participating in this Giveaway, entrants agree to be bound by these Official Rules.  The Sponsor reserves the right to disqualify from the Giveaway any entrant it believes has violated these Official Rules.   All federal, state and local laws apply. In the event any portion of this Giveaway is compromised by activities beyond the reasonable control of the Sponsor which, in the sole opinion of the Sponsor, corrupts or impairs the administration, security, fairness or proper play of this Giveaway, the Sponsor reserves the right at its sole discretion to modify, suspend or terminate the Giveaway. Entering the Giveaway by submitting on https://www.facebook.com/DavesKillerBread constitutes permission for the Sponsor and the Giveaway Entities to use and reproduce participants’ names (first name and last initial) and recipes for purposes of advertising, promotion, publicity, consumer newsletters and social media channels (Facebook and Twitter) without compensation, unless prohibited by law.  Entries to the Giveaway (including any copyrights or other intellectual property rights therein) will become the property of the Sponsor and, should the Sponsor choose to use or reproduce this content for promotional purposes, entrant is not entitled to compensation or credit except as expressly set forth herein.

Neither the Sponsor nor any of the Giveaway Entities are responsible for lost, late, misdirected, undeliverable or incomplete entries, whether due to system errors or failures, faulty transmissions or other telecommunications malfunctions, entries not received resulting from any hardware or software failures of any kind, lost or unavailable network connections, failed, incomplete or garbled computer or telephone transmissions, typographical or system errors and failures, faulty transmissions, technical malfunctions, or otherwise.  The Sponsor may prohibit an entrant from participating in the Giveaway or winning the PRIZE if, in its sole discretion, the Sponsor determines that said entrant is attempting to undermine the legitimate operation of the Giveaway by cheating, hacking, deception, or other unfair playing practices or intending to annoy, abuse, threaten or harass any other entrants, the Sponsor, or any of the Giveaway Entities. If for any reason the Giveaway is not able to be conducted as planned, including, but not limited to, by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud or any other causes beyond the reasonable control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Giveaway, then the Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Giveaway and select a winner from those entries received up to the cancellation/suspension date. 

CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE GIVEAWAY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE GIVEAWAY MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

NO LIABILITY:  By participating in the Giveaway, entrants agree to release, discharge, indemnify and hold harmless the Sponsor and all Giveaway Entities and each of their respective officers, directors, employees, representatives and agents from and against any claims made by the winner, entrants, or any other third parties, related in any way to the operation of the Giveaway as well as any other claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any PRIZE or participation in any Giveaway-related activity or participation in the Giveaway.
