1. ELIGIBILITY. This promotion is open to legal residents of the United States and the District of Columbia who are at least 18 years old at the time of entry. Employees, officers, directors, or agents of Sponsor, its affiliates, subsidiaries, advertising and promotion agencies, (collectively, the “Promotion Entities”) and their immediate family members and household members (parents, children, siblings, or spouse, regardless of where they live, or persons living in the same household, whether related or not) are not eligible to participate. Void in Puerto Rico, U.S. territories and possessions outside of the 50 United States, Canada, and where restricted or prohibited by law.
2. PROMOTION PERIOD. The Summer Berry Bagel Giveaway Promotion (the “Promotion”) begins at 9 a.m. EST on 6/10/2026 and ends at 11:59pm EST on 6/24/2026 ("Promotion Period").
3. HOW TO ENTER. During the Promotion Period, follow @daveskillerbread on Instagram, comment on the designated post with your answer to the question posed.
If a participant enters using a mobile device, message and data rates may apply. Participants should consult their wireless providers’ pricing plans.
4. ENTRIES. Participants are limited to one (1) entry per Promotion Period. Proof of submitting an entry does not constitute proof of delivery or entry. Entries cannot contain profanity, violence, threatening language, illegal or offensive material, derogatory or defamatory comments, or be inappropriate, indecent or obscene as determined by Sponsor, in its sole discretion. Entries must be in keeping with Sponsor’s image, and may not violate the privacy rights or publicity rights of any person or otherwise infringe upon any person’s or entity’s intellectual property, personal or proprietary rights. All non-conforming entries will be disqualified, as determined in Sponsor’s sole discretion. Sponsor reserves the right, in its sole discretion, to remove any entry posted that Sponsor feels is inappropriate, objectionable and/or inconsistent with the positive image or goodwill it wishes to promote in this Promotion. You agree to hold Sponsor harmless in the event that your entry violates any third-party intellectual property, publicity or privacy rights. Entries may not be acknowledged. If any entry is removed by Sponsor, the entry is automatically disqualified. All entries must comply with these Official Rules. By submitting an entry, participant grants Sponsor a non-exclusive, royalty-free, worldwide license to use, reproduce, and display the entry for purposes of administering and promoting this Promotion and Sponsor's products, without further compensation or credit to participant.
5. WINNER SELECTION. Two Winner(s) will be selected in a random drawing from all eligible entries received during the Promotion Period. Drawing will be conducted on or about 6/25/2026 by Sponsor or its designated agent. Odds of winning depend on the number of eligible entries received.
6. WINNER NOTIFICATION. Winner will be notified via direct message on the platform where they entered within 48 hours of selection. Winner must respond within 72 hours or an alternate winner will be selected. Winner may be required to complete an affidavit of eligibility and liability/publicity release.
7. PRIZE. There are two (2) prize packages available to be won, 2 packs of the Summer Berry Bagel and 24 free product vouchers with an approximate retail value of $255. The Total ARV for this giveaway is $510. Prize is non-transferable and no cash substitution is allowed.
Sponsor reserves the right to substitute a prize of equal or greater value.
8. PUBLICITY RELEASE. By entering, each participant grants Sponsor and its designees the perpetual, worldwide right and permission to use their name, address, voice, statements, photograph, image, and likeness for advertising, trade, promotional, and publicity purposes in any and all media now known or hereafter discovered, without further notice, review, consent, payment, or other consideration, except where prohibited by law.
9. RELEASE AND LIMITATION OF LIABILITY. By participating, each entrant agrees to release and hold harmless Sponsor, its parent companies, subsidiaries, affiliates, advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents (collectively, "Released Parties") from and against any and all claims, damages, disabilities, losses, costs, injuries, and expenses (including, without limitation, reasonable attorneys' fees) arising out of or in connection with: (a) participation in this promotion; (b) the acceptance, possession, use, or misuse of any prize; (c) any technical malfunctions, failures, or difficulties; (d) unauthorized human intervention in any part of the entry process; (e) electronic or human error in the administration of the promotion or processing of entries; or (f) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the promotion. This release applies regardless of whether the claim arises under contract, tort, strict liability, or any other legal theory.
10. GENERAL CONDITIONS. By participating in this Promotion, participants agree to be bound by these Official Rules. All federal, state and local laws apply. Any attempted form of participation in the Promotion other than as described herein is void. Entries received from any participant in excess of the stated limitation will be void. Multiple participants are not permitted to share the same email address. If it is discovered that a participant attempts to receive additional entries in excess of the stated limitation, including, without limitation, if a participant is found to use multiple email addresses to enter this Promotion, that participant may, at Sponsor’s sole discretion, be disqualified from the Promotion. In the event of a dispute regarding the identity of the person submitting an entry, the “authorized account holder” (determined at time of entry) of the account used to enter will be deemed to be the participant. The “authorized account holder” is the natural person who is assigned to the email address through the email platform. Potential winners may be required to show proof of being the authorized account holder.
Sponsor reserves the right to disqualify any individual found, in Sponsor’s sole discretion, to be tampering with the operation of the Promotion, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike manner or with the intent to disrupt the normal operation of the Promotion. Any use of robotic, automatic, macro, programmed, third party, or like methods to participate in the Promotion may void any attempted participation effected by such methods and may result in the disqualification of the individual utilizing the same. Sponsor reserves the right to disqualify from the Promotion any participant it believes has violated these Official Rules. Sponsor may prohibit a participant from participating in the Promotion or winning the prize if, in its sole discretion, Sponsor determines that said participant is attempting to undermine the legitimate operation of the Promotion by cheating, hacking, deception, or other unfair playing practices or intending to annoy, abuse, threaten or harass any other participants, Sponsor, or any of the Promotion Entities. If for any reason the Promotion is not able to be conducted as planned, including, but not limited to, by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud or any other causes beyond the reasonable control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, then Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Promotion and select a winner from those entries received up to the cancellation/suspension date.
In the event of any conflict with any details contained in these Official Rules and any details contained in any promotional materials of the Promotion (including, but not limited to, point-of-sale, television and print advertising, promotional packaging, and other promotional media), the details of the Promotion set forth in these Official Rules shall prevail.
11. PRIVACY. Promotion Entities and their authorized agents will collect, use, and disclose the personal information entrant provides when entering the Promotion solely for the purposes of administering the Promotion and fulfilling prizes, and by entering this Promotion entrant consents to the collection, use, disclosure and management of his/her personal information for said purposes. All personal information that entrant submits will be subject to Sponsor’s privacy policy. In the event of any discrepancy between Sponsor’s privacy policy and these Official Rules, the privacy policy will govern and control. 12. DISPUTES. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of participant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Georgia, without giving effect to any choice of law or conflict of law rules, which would cause the application of laws of any jurisdiction other than the State of Georgia. If any part of these Official Rules is deemed to be invalid or otherwise unenforceable or illegal, the balance of the Official Rules shall remain in full force and effect and shall be construed in accordance with its terms as if the invalid or illegal provision were not contained herein. Except where prohibited, participants agree that (1) any and all disputes, claims, and causes of action arising out of or connected with this Promotion or any prize awarded shall be resolved individually, WITHOUT RESORT TO ANY FORM OF CLASS ACTION, and exclusively by a federal or state court located in Georgia, (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys’ fees, and (3) UNDER NO CIRCUMSTANCES WILL PARTICIPANT BE PERMITTED TO OBTAIN AWARDS FOR, AND PARTICIPANT HEREBY WAIVES ALL RIGHTS TO CLAIM, INDIRECT, PUNITIVE, INCIDENTAL, AND CONSEQUENTIAL DAMAGES AND ANY OTHER DAMAGES, OTHER THAN FOR ACTUAL OUT-OF-POCKET EXPENSES, AND ANY AND ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED.

14. WINNER LIST. For a list of winners, send a self-addressed, stamped envelope to Flowers Bakeries, LLC c/o Tombras within 60 days of the end of the Promotion Period.
